The Formation of Customary International Law and Its Methodological Challenges

Developing a methodological underpinning for customary international law has been a constant challenge. Indeed, customary law has become an inspiring source for innovative legal theories. Lacking a coherent theoretical basis, critics have suggested that customary international law has an “identity crisis”, or is “situated in a theoretical minefield.” Indeed, there appears to be no common consensus, on either a catalogue of specific rules that have attained the status of customary law, or on the doctrinal and methodological approaches required to establish and determine customary international law as a source of law. When discussing customary international law as a source of international law three levels have to be distinguished: (1) the nature of customary international law, (2) the constitutive elements necessary for the formation of customary international law and (3) the evidence for the identification of customary international law.

Customary international law is one of the three main sources of international law; lamentably, it has historically received little attention from law and economics scholars, despite providing rich material for economic analysis. In this chapter, we provide a concise overview of recent research on customary international law from a law and economics perspective, summarizing the main results while modestly extending some of the analyses presented.

Customary law grows out of the social practices which a given jural community has come to accept as obligatory. It is a pervasive normative order, providing the regulatory framework for spheres of human activity as diverse as the family, the neighbourhood, the business of merchant banking, or international diplomacy. This article looks at the indigenous customary laws of sub-Saharan Africa. It deals with the preservation of the law in an oral tradition and how it has been influenced by certain social, economic, and political structures. This focus requires, in turn, that particular attention be paid to factors influencing the production of texts on customary law. Because textual information on the subject is limited, often outdated, and somewhat subjective, readers must be made aware of how changes in the theories of jurisprudence and anthropology have affected ideas and preconceptions.
