Sample Instructions for Form I-539 to Extend a USA Visitor Visa

Many people have questions or doubts on how exactly to fill out a I-539 form to extend or change non-immigrant status in the U.S. This form is required for any non-immigrant visa, such as a Visitor Visa  or  Business Visa , for whom you would like to extend their stay in the U.S. This page describes in detail how exactly to fill an I-539 for extending a visitor visa (B2). Of course, you will have to fill in your specific details, and depending upon your circumstances, you may have to answer the questions differently than shown in this generic sample application.

Look at this  Sample I-539  to get an idea how a typical application may look like. 

Step by step instructions for each field in the I-539:

Part 1 : Your name and address. It is self explanatory. For ‘In Care of’ field, you can write the name of the person with whom you are staying.

Social Security Number:  Unless you are changing from a visa status that allowed you to work, you don’t have a social security number. Don’t write anything in there in that case. Visitors are not given a social security number. 

A#:  A# number stands for eight-digit alien number. You will have an A# number only if you filed certain immigration petitions, such as an I-485, EAD, etc. Visitors don’t have an A# number and you can write “None” in this field. 

I-94#:  This number is on the  Form I-94  that you can print from the CBP website. If this date is already in the past, you are already out of status, and you cannot apply for this extension. If you entered the US on a   visa waiver program , it is an I-94W, but you can’t extend your stay in the U.S. and therefore cannot file this form. 

Current Nonimmigrant Status:  “B2” if you are on a visitor visa. “B1” if you are on a business visa. 

Passport:  Enter details about the passport’s expiration date and country of issuance. If your passport is not going to be valid for the entire duration of the extended status requested, you should first get it renewed before filing this extension application. 

Foreign Consulates in the USA . 

If you wait for a passport renewal, it will delay your application, and you may lose your eligibility to apply for an extension. You can just write the current passport expiration date, and then add the words “renewal pending”. Of course, you can write those words only if you have already applied for the passport renewal, and it is actually pending.

Part 2:  Application Type

1. Since you are applying for the extension of a B1/B2 visa, check “2”.  2. If you are applying only for yourself, check “4”, otherwise check “5a”. If you checked “5a”, write the total number of applicants in this form, including yourself. You have to complete the I-539 Supplement A for each co-applicant. You can include your spouse and minor children in one application form.

Part 3:  Processing Information

1. Mention the date to which you would like to extend your stay in the USA. Provide copies of air tickets that match this date. The maximum duration is up to 6 months from the date on your current I-94 card. 2. No. 3a. No. 4. N/A.

Part 4:  Additional Information

1.  The country from which your passport was issued. e.g., “India”. You need to mention this only if it is different from Part 1. 

2.  Self explanatory. Your foreign address. 

Answer the following questions. If you answer “Yes” to any question, explain it on a separate sheet of paper. 

These questions are asked to determine whether you are inadmissible. 

3.  Are you, or any other person included on the application, an applicant for an immigrant visa? 

If you or any family member in this form have applied for an “immigrant visa”, it is quite obvious that you have no intention of going back to your home country, and that you want to stay in the U.S. forever. Therefore, your application for an extension will be denied. There is nothing you can do about it. 

4.  Has an immigrant petition EVER been filed for you or for any other person included in this application? 

If someone has filed an immigrant petition for you or your family member in this application, you have to answer “Yes”. Even though it may take many years before you actually get an immigrant visa, USCIS still may deny your application. 

5.  Has a Form I-485, Application to Register Permanent Residence or Adjust Status, ever been filed by you or by any other person included in this application? 

This is pretty much the same as Question 3. I-485 is filed in the U.S., while consular processing is done overseas. 

6.  Have you, or any other person included in this application, ever been arrested or convicted of any criminal offense since last entering the U.S.? 

If you were just arrested but were not charged, say “Yes”, but attach a detailed explanation of the situation. If you were arrested, whether found guilty or not, consult an immigration and criminal lawyer first before filing this application. If you were never arrested, of course say ‘No. 

7.a. through 7.e., 8 through 11.  Answer accordingly. If the answer to any of them are “Yes”, please consult an immigration attorney before applying. 

12.  Have you, or any other person included in this application, done anything that violated the terms of the nonimmigrant status you now hold? 

Violating the terms means doing something you were not supposed to do. If you are a visitor, you are not supposed to work, and if you worked, you have violated the terms. If you have not done anything like that, say “No”. 

13.  Are you, or any other person included in this application, now in removal proceedings?  If you are in “removal proceedings”, don’t file this application without talking to an immigration lawyer first. If this is not applicable to you, say “No”. 

14.  Have you, or any other person included in this application, been employed in the U.S. since last admitted or granted an extension or change of status? 

You should not have been employed in the U.S. as a visitor; therefore, the answer would be “No”. If you have been working in the U.S. as a visitor or business visa holder, you are already in trouble.

Part 5: Signature

Sign here, write your name, and write the date. If you are illiterate and cannot sign, put the finger print of the index finger of your right hand, and get this application filled by someone else, such as your son/daughter. 

Answer whether you can read and understand English and whether you have answered the questions in the form yourself, or whether someone translated the questions for you. If the latter, please write the language you can read questions in, e.g., “Tamil”, “Telugu”, “Chinese”, etc.

Part 6: Interpreter’s Statement

If someone else interpreted the questions and answers in this form, they should mention the language used for interpretation other than English; Write their name, date, and contact information. Now, sign accordingly.

Part 7:  Signature of person preparing form, if other than above.

If someone else helped you prepare this application, that person should write his/her name and address. Otherwise, leave it blank.

Step by step instructions for each field in the I-539 Supplement A:

This form needs to be filled for your spouse and minor children who are applying along with the primary applicant. Only one form needs to be filled for your spouse and any minor children.

Date of Arrival: Date of your last arrival into the United States. Current non-immigrant status:  B2 for a visitor visa or B1 for a business visa. Expires on:  Date when the current status will expire. i.e., the date in the I-94 card. Expiration date:  Expiration date of the passport.

What are the requirements for extending my stay.

According to Path2usa, B1 and B2 visa holders can extend their stay if:

  • You have a valid legitimate reason to request for visa extension, under the visa category.
  • You were lawfully admitted into the United States with a non-immigrant visa
  • Your non-immigrant US visa status remained valid
  • You have not committed any crimes that make you ineligible for a visa
  • You have not violated the conditions of your admission to the USA
  • Your passport is valid and will remain valid for the duration of your stay.
  • You have definite plans to leave the US at the end of the proposed visa extension period.
  • Proper evidence for financial support is provided.

What Documents Do You Need to Complete for a US Visa Extension?

You’ll need to:

  • Fill out and complete form I-539 . You can do this online, by the mail, or in person at a USCIS office
  • If you file online, you’ll need to understand how to submit attachments of the document you’ll need
  • File an application (letter) stating the reasons for requesting a visa extension
  • Provide proof you can support yourself financially during the extension – such as bank account statements and employer statements
  • Supply a copy of your return airline or shipping tickets
  • Pay the filing fees ($370) and any biometric fee ($85). Generally, your spouse and children are included in these fees
  • Provide a copy (not the original) of your I-94 for each applicant

Be sure to read the extension checklist and to follow the sample cover letter that the USCIS provides.

When Should the Visa Extension Request be field?

The USCIC recommends that you request an extension at least 45 days before your visa expiration date ends. Generally, USCIS must receive your completed application and fees by the day your authorized stay ends.

What Happens After you File the Extension Request?

The USCIS will send you a receipt with a 13 digit case number. “The approximate processing time will be indicated on the receipt.” You may be given a biometrics appointment so you and anyone else on the application can be fingerprinted and photographed

If you file your extension request on time, you may be permitted to stay in the US for up to an additional 240 days depending on the reasons behind your request and other factors.

You can check the status of your request online through the receipt case number.

If the visa extension is approved, you will be given a replacement I-94 with the new expiration/departure date. You should make copies of this I-94 so you’ll have them for subsequent trips to the United States.

If the visa extension request is denied, you’ll receive written notice of the denial. You will need to leave the US immediately .

“If USICS receive your application before your status expires (or, in exceptional cases, we excuse filing after your status expires due to circumstances beyond your control), and if you have not violated the terms of your status and meet the basic eligibility requirements, then you may continue your previously approved activities in the U.S.( including previously authorized work, for a period of up to 240 days), until we make a decision on your application or until the reason for your requested extension has been accomplished- whichever comes first.”

What if I file on time for a Visa Extension, but I leave America before USCIS makes a decision on my application?

“If you leave the US before a decision is made on your application to extend and you plan to return to the U.S. in the future, please keep a copy of your application plus the receipt notice to show to the Immigration Inspector on your return travel to the U.S. Otherwise, you may be denied entry for overstaying on your last visit.”

  • Photocopy of the Bio data page of applicant’s passport + Page on which Arrival Stamp has been affixed,

  • Upon approval , confirmed ticket should be produced,

 (a)  A letter of sponsorship stating :

          (i)   Name and address ;

          (ii)  Telephone number;

         (iii)  Profession; and

Ottawa, February 5, 2024— Further information is being provided to clarify the announcement of an intake cap on new international study permit applications and other changes . International students make important contributions to Canada’s campuses, communities and economy; however, we have seen unsustainable growth in the International Student Program in recent years. These recently announced reforms will support sustainable population growth in Canada and improve system integrity, while helping to ensure that international students have a positive experience in Canada.

1. Cap and provincial attestation letter

As of 8:30 a.m. ET on January 22, 2024, most new post-secondary international students at the college or undergraduate level must provide a provincial attestation letter (PAL) from a province or territory with their study permit application. Immigration, Refugees and Citizenship Canada (IRCC) will return any application received that does not include a PAL, unless otherwise exempt.

This attestation will serve as proof that the student has been accounted for under a provincial or territorial allocation within the national cap. Provinces and territories have been asked to have a plan in place for issuing PALs by March 31, 2024. The Government of Canada is working with the Government of Quebec to determine how the certificat d’acceptation du Québec pour études could serve as a PAL.

International students whose applications were received by IRCC before 8:30 a.m. on January 22, 2024, as well as those who have already been approved for a study permit and intend to travel to Canada for an upcoming program, do not need to take further action as a result of the cap.

2. Post-graduation work permit (PGWP) update for graduates of master’s degree programs

In recognition that graduates of master’s degree granting programs are excellent candidates to succeed in Canada’s labour market and potentially transition to permanent residence, we have made a change to the length of the PGWP, so that they have the opportunity to meet the required Canadian work experience in order to apply for their permanent residence.

Starting on February 15, 2024, a longer, 3-year post-graduation work permit will be available to those who are graduating from a master’s degree program that is less than 2 years and who meet all other PGWP eligibility criteria.

The length of PGWPs for programs other than master’s degrees will continue to align with the length of the study program, to a maximum of 3 years.

Who is eligible for a longer post-graduation work permit (PGWP)?

  • Graduates of programs that are at least two years in length at PGWP-eligible designated learning institutions are eligible for a 3-year PGWP, as are graduates of master’s degree programs less than 2 years in length.

3. PGWP eligibility for public-private partnership college programs

Some provinces allow public colleges to license their curriculum to be delivered by an affiliated private college. In these cases, students physically attend a private college, but graduate with a diploma from a public institution. Concerns have been raised with regard to the quality of education provided by these institutions, as well as the lack of sufficient student supports. The Auditor General of Ontario has also raised concerns about a lack of oversight into program quality and student services at these institutions.

As such, IRCC has made a change to restrict PGWPs for these institutions, anticipating that without the ability to apply for a PGWP, there will be a reduction in the number of international students enrolling in them.

Who is eligible for a PGWP after graduating from a public-private partnership college program?

  • International students currently enrolled will remain eligible for a PGWP if they meet other program eligibility criteria.

Who is not eligible for a PGWP after graduating from a public-private partnership college program?

  • New students enrolling in this type of program will not be eligible for a post-graduation work permit.

4. Changes to open work permit eligibility for spouses

In the coming weeks, eligibility for open work permits for the spouses and common-law partners of international students will be updated.

Who can get an open work permit?

  • Eligibility is limited to the spouses and common-law partners of students in graduate (master’s and doctorate) and professional degree–granting programs only.
  • Once these changes are in effect, spouses and common-law partners of international students seeking to extend their existing work permit will continue to be eligible under this stream.

Who will not be eligible for an open work permit?

  • The spouses and common-law partners of international students in other levels of study, including undergraduate and college programs, will no longer be eligible for an open work permit unless they already hold an open work permit under this stream.
