How to Convince an Audience: Opinion versus Persuasion

You may be very good at expressing your opinions, especially when you want to change someone’s mind.

What you may not know is that if you truly want to change someone’s mind, you have to stop thinking about your opinion and start thinking about your audience.

This tutorial, with a free infographic to download, will show you very clearly the difference between writing an opinion and writing to persuade an audience.

Opinion versus Persuasion

Writing or expressing an opinion is all about what you like; convincing another person to do something is all about what they need to hear to be persuaded.

Here’s an infographic that shows the difference between writing an opinion and writing to persuade. After the infographic, I’ve included a short writing exercise you can do quickly. My writing class just did it, and they had fun sharing their ideas about alligators, snow leopards, snakes, and so forth.

Your students will learn the difference between opinion versus persuasion with this fun infographic about dogs. Then they all do an easy writing exercise.

Writing exercise: Do this one step at a time. 

1. Write your opinion of an animal you love or hate. It can be a particular animal (“I love my pet alligator”) or all animals of a kind (“I hate all snakes”). Then make a list of about 3-5 reasons why you love or hate this animal. When you have finished your list, put it aside.

Note: When you have strong feelings about your topic, writing is easier. One student in my class had a hard time coming up with three reasons why she disliked her animal. I asked her to think about an animal she had some strong feelings about—really loved or truly hated. She switched her animal to snakes and wrote four wonderful reasons why she hated snakes.

2. Now you are going to persuade a friend to buy this animal as a pet. Make a list of 3-5 reasons why your friend should buy this animal as a pet. Or, if you wrote about a hated animal, persuade a friend NOT to buy this animal as a pet. Make a list of 3-5 reasons why your friend should avoid this animal as a pet.

3. Make a Venn diagram like the one in the infographic, if you wish. Look at both lists. How many reasons are the same in both lists? How many are different? WHY are they different?

By now I think you see that when you write to persuade others, you will be more effective if you make your list of points fit your audience. Take yourself out of the equation and try to connect your audience with your topic.

The difference between an argumentative and persuasive essay isn’t always clear. If you’re struggling with either style for your next assignment, don’t worry. The following will clarify everything you need to know so you can write with confidence.

While argumentative essays aim to present one's point of view, persuasuve essays aim to get the reader on one's side.

Both argumentative and persuasive essays require you to present your point of view on a specific topic. However, your approach will differ between the two. The words “argumentative” and “persuasive” should help you recognize what you are expected to achieve. Let’s see how.

For the argumentative essay, it is sufficient to present your point of view and nothing more. That said, the information you present should come across as being reliable enough for the readers. They don’t need to agree with your take on the issue at hand. The reader need only acknowledge that your point of view is worth considering.

In a persuasive essay, however, your goal is to get the reader on your side. And so, in addition to presenting sensible information, you want the reader to share your opinion.

🎬 Argumentative vs. Persuasive Essay: How to Start

For either type of essay, the foundation is generally the same. Before even thinking about your introduction, settle on a topic that genuinely interests you. What follows will differ for argumentative and persuasive essays.

In the case of argumentative writing, it’s crucial to have all the information you need to build up a strong set of arguments and examples. Therefore, don’t forget to spend some time researching your topic in earnest. Once you have all the data, you can easily choose which side to take. Never force a paper to align with your personal opinion if you don’t have enough supporting evidence.

In the case of a persuasive essay, your job is to make sure you have a decent topic and identify which side to support. The starting point is a bit less complicated.

✍️ Persuasive vs. Argumentative Essays: Writing Technique

This is where things get interesting in the clash between persuasive and argumentative writing. For college-level writing, it’s never enough to follow a general essay outline . Getting that coveted higher mark requires that you know the unique yet subtle features of both writing styles.

Topical and relevant reasons are the backbone of any argumentative text. This is where preliminary research comes in. Having requisite evidence and facts from credible sources ensures the worthiness of your essay. That way, the reader can validate your point of view.

As with argumentative writing, persuasive essays should include some measure of supporting facts. What distinguishes persuasive writing is that you must also engage the reader on an emotional level. Moreover, there’s no need to present opposing opinions. Your goal is to make the reader take your side. All’s fair in love and war!

👁️ Persuasive vs. Argumentative Essays: Point of View

Let’s talk more about presenting different opinions. You were probably taught that an academic essay includes at least three arguments and an additional counterargument . Keep in mind, however, that this rule applies only to argumentative essays, in which you introduce three or more arguments with evidence to support your point of view. You then offset that point of view by including an opposing opinion. By doing so, you allow the reader to choose a side, even though the facts, as you’ve presented them, are in favor of your opinion. This is a logic-based approach.

In a persuasive essay, you’re not likely to entertain the opposition. Your conviction is the very essence of the essay. Your take on the issue in question must come across as the only sensible approach. If you’re feeling confident, you’re welcome to include a counterargument, but only if you decimate it right away!

👏 The Audience of Argumentative vs. Persuasive Essays

We’ve seen the differences and similarities between argumentative and persuasive writing and walked you through the technical aspects of both. But there’s one final piece of the puzzle to be considered: the question of your audience. This is the biggest difference of them all.

When writing an argumentative essay, remember that you don’t need to convince anyone. There is no audience. You’re simply presenting the information you gathered without expecting anything in return (except maybe a pat on the back from your teacher).

Without an audience, there’s no one to persuade. This touches on another crucial element of the writing process : understanding what and how your readers think. This allows you to pick the best strategy to convince them to join your side.

❓ What’s the Difference between a Persuasive Essay and an Argumentative Essay?

The main difference between a persuasive essay and an argumentative essay comes down to your audience. For persuasive writing, it’s necessary to feel out your audience and wield that knowledge to prove the efficacy of your perspective. For argumentative writing, opt for a logical approach and just present the facts with no intent to persuade anyone.

Many teachers think argumentative and persuasive writing are the same. Some would go as far as to say that persuasive writing has just turned into argumentative because of Common Core (not true). And where does opinion writing fall into all of this?

First of all, if you are a 1st-5th grade teacher, Common Core only expects students to master writing opinion pieces and work on short research projects. Argumentative writing does not come into play until 6th grade. Oh and those research projects students do in 1st-5th, you better believe those skills come into play when students start writing argumentatively in the upper grades! The graphic below describes the differences between opinion, persuasive and argumentative writing.

As you can see argumentative writing relies a lot more on reasoning and evidence which comes from a lot of in-depth annotation of articles.

Persuasive writing does not necessarily require all that much research. Opinion writing is the foundation for both. I also believe that opinion writing is dull! Persuasive writing requires an audience and can include debates which can be motivating and fun for students.

Just because persuasive writing is not mentioned in the Common Core doesn’t mean teachers should write it off entirely!

 THE PURPOSE OF PERSUASIVE WRITING

The purpose of persuasion in writing is to convince, motivate, or move readers toward a certain point of view, or opinion. The act of trying to persuade automatically implies more than one opinion on the subject can be argued.

The idea of an argument often conjures up images of two people yelling and screaming in anger. In writing, however, an argument is very different. An argument is a reasoned opinion supported and explained by evidence. To argue in writing is to advance knowledge and ideas in a positive way. Written arguments often fail when they employ ranting rather than reasoning.

Most of us feel inclined to try to win the arguments we engage in. On some level, we all want to be right, and we want others to see the error of their ways. More times than not, however, arguments in which both sides try to win end up producing losers all around. The more productive approach is to persuade your audience to consider your opinion as a valid one, not simply the right one.

THE STRUCTURE OF A PERSUASIVE ESSAY

The following five features make up the structure of a persuasive essay:

  • Introduction and thesis
  • Opposing and qualifying ideas
  • Strong evidence in support of claim
  • Style and tone of language
  • A compelling conclusion

CREATING AN INTRODUCTION AND THESIS

The persuasive essay begins with an engaging introduction that presents the general topic. The thesis typically appears somewhere in the introduction and states the writer’s point of view.

Avoid forming a thesis based on a negative claim. For example, “The hourly minimum wage is not high enough for the average worker to live on.” This is probably a true statement, but persuasive arguments should make a positive case. That is, the thesis statement should focus on how the hourly minimum wage is low or insufficient.

ACKNOWLEDGING OPPOSING IDEAS AND LIMITS TO YOUR ARGUMENT

Because an argument implies differing points of view on the subject, you must be sure to acknowledge those opposing ideas. Avoiding ideas that conflict with your own gives the reader the impression that you may be uncertain, fearful, or unaware of opposing ideas. Thus it is essential that you not only address counterarguments but also do so respectfully.

Try to address opposing arguments earlier rather than later in your essay. Rhetorically speaking, ordering your positive arguments last allows you to better address ideas that conflict with your own, so you can spend the rest of the essay countering those arguments. This way, you leave your reader thinking about your argument rather than someone else’s. You have the last word.

Acknowledging points of view different from your own also has the effect of fostering more credibility between you and the audience. They know from the outset that you are aware of opposing ideas and that you are not afraid to give them space.

It is also helpful to establish the limits of your argument and what you are trying to accomplish. In effect, you are conceding early on that your argument is not the ultimate authority on a given topic. Such humility can go a long way toward earning credibility and trust with an audience. Audience members will know from the beginning that you are a reasonable writer, and audience members will trust your argument as a result. For example, in the following concessionary statement, the writer advocates for stricter gun control laws, but she admits it will not solve all of our problems with crime:

Although tougher gun control laws are a powerful first step in decreasing violence in our streets, such legislation alone cannot end these problems since guns are not the only problem we face.

Such a concession will be welcome by those who might disagree with this writer’s argument in the first place. To effectively persuade their readers, writers need to be modest in their goals and humble in their approach to get readers to listen to the ideas. See Table 10.5 “Phrases of Concession” for some useful phrases of concession.

Try to form a thesis for each of the following topics. Remember the more specific your thesis, the better.

BIAS IN WRITING

Everyone has various biases on any number of topics. For example, you might have a bias toward wearing black instead of brightly colored clothes or wearing jeans rather than formal wear. You might have a bias toward working at night rather than in the morning, or working by deadlines rather than getting tasks done in advance. These examples identify minor biases, of course, but they still indicate preferences and opinions.

Handling bias in writing and in daily life can be a useful skill. It will allow you to articulate your own points of view while also defending yourself against unreasonable points of view. The ideal in persuasive writing is to let your reader know your bias, but do not let that bias blind you to the primary components of good argumentation: sound, thoughtful evidence and a respectful and reasonable address of opposing sides.

The strength of a personal bias is that it can motivate you to construct a strong argument. If you are invested in the topic, you are more likely to care about the piece of writing. Similarly, the more you care, the more time and effort you are apt to put forth and the better the final product will be.

The weakness of bias is when the bias begins to take over the essay—when, for example, you neglect opposing ideas, exaggerate your points, or repeatedly insert yourself ahead of the subject by using I too often. Being aware of all three of these pitfalls will help you avoid them.

THE USE OF I IN WRITING

The use of I in writing is often a topic of debate, and the acceptance of its usage varies from instructor to instructor. It is difficult to predict the preferences for all your present and future instructors, but consider the effects it can potentially have on your writing.

Be mindful of the use of I in your writing because it can make your argument sound overly biased. There are two primary reasons:

  • Excessive repetition of any word will eventually catch the reader’s attention—and usually not in a good way. The use of I is no different.
  • The insertion of I into a sentence alters not only the way a sentence might sound but also the composition of the sentence itself. I is often the subject of a sentence. If the subject of the essay is supposed to be, say, smoking, then by inserting yourself into the sentence, you are effectively displacing the subject of the essay into a secondary position. In the following example, the subject of the sentence is underlined:
Smoking is bad. I think smoking is bad.

In the first sentence, the rightful subject, smoking, is in the subject position in the sentence. In the second sentence, the insertion of I and think replaces smoking as the subject, which draws attention to I and away from the topic that is supposed to be discussed. Remember to keep the message (the subject) and the messenger (the writer) separate.

Developing Sound Arguments

Does my essay contain the following elements?

  • An engaging introduction
  • A reasonable, specific thesis that is able to be supported by evidence
  • A varied range of evidence from credible sources
  • Respectful acknowledgement and explanation of opposing ideas
  • A style and tone of language that is appropriate for the subject and audience
  • Acknowledgement of the argument’s limits
  • A conclusion that will adequately summarize the essay and reinforce the thesis

FACT AND OPINION

Facts are statements that can be definitely proven using objective data. The statement that is a fact is absolutely valid. In other words, the statement can be pronounced as true or false. For example, 2 + 2 = 4. This expression identifies a true statement, or a fact, because it can be proved with objective data.

Opinions are personal views, or judgments. An opinion is what an individual believes about a particular subject. However, an opinion in argumentation must have legitimate backing; adequate evidence and credibility should support the opinion. Consider the credibility of expert opinions. Experts in a given field have the knowledge and credentials to make their opinion meaningful to a larger audience.

For example, you seek the opinion of your dentist when it comes to the health of your gums, and you seek the opinion of your mechanic when it comes to the maintenance of your car. Both have knowledge and credentials in those respective fields, which is why their opinions matter to you. But the authority of your dentist may be greatly diminished should he or she offer an opinion about your car, and vice versa.

In writing, you want to strike a balance between credible facts and authoritative opinions. Relying on one or the other will likely lose more of your audience than it gains.

The word prove is frequently used in the discussion of persuasive writing. Writers may claim that one piece of evidence or another proves the argument, but proving an argument is often not possible. No evidence proves a debatable topic one way or the other; that is why the topic is debatable. Facts can be proved, but opinions can only be supported, explained, and persuaded.

On a separate sheet of paper, take three of the theses you formed in Exercise 1, and list the types of evidence you might use in support of that thesis.

Using the evidence you provided in support of the three theses in Exercise 2, come up with at least one counterargument to each. Then write a concession statement, expressing the limits to each of your three arguments.

USING VISUAL ELEMENTS TO STRENGTHEN ARGUMENTS

Adding visual elements to a persuasive argument can often strengthen its persuasive effect. There are two main types of visual elements: quantitative visuals and qualitative visuals.

Quantitative visuals present data graphically. They allow the audience to see statistics spatially. The purpose of using quantitative visuals is to make logical appeals to the audience. For example, sometimes it is easier to understand the disparity in certain statistics if you can see how the disparity looks graphically. Bar graphs, pie charts, Venn diagrams, histograms, and line graphs are all ways of presenting quantitative data in spatial dimensions.

Qualitative visuals present images that appeal to the audience’s emotions. Photographs and pictorial images are examples of qualitative visuals. Such images often try to convey a story, and seeing an actual example can carry more power than hearing or reading about the example. For example, one image of a child suffering from malnutrition will likely have more of an emotional impact than pages dedicated to describing that same condition in writing.

WRITING AT WORK

When making a business presentation, you typically have limited time to get across your idea. Providing visual elements for your audience can be an effective timesaving tool. Quantitative visuals in business presentations serve the same purpose as they do in persuasive writing. They should make logical appeals by showing numerical data in a spatial design. Quantitative visuals should be pictures that might appeal to your audience’s emotions. You will find that many of the rhetorical devices used in writing are the same ones used in the workplace. 

WRITING A PERSUASIVE ESSAY

Choose a topic that you feel passionate about. If your instructor requires you to write about a specific topic, approach the subject from an angle that interests you. Begin your essay with an engaging introduction. Your thesis should typically appear somewhere in your introduction.

Start by acknowledging and explaining points of view that may conflict with your own to build credibility and trust with your audience. Also state the limits of your argument. This too helps you sound more reasonable and honest to those who may naturally be inclined to disagree with your view. By respectfully acknowledging opposing arguments and conceding limitations to your own view, you set a measured and responsible tone for the essay.

Make your appeals in support of your thesis by using sound, credible evidence. Use a balance of facts and opinions from a wide range of sources, such as scientific studies, expert testimony, statistics, and personal anecdotes. Each piece of evidence should be fully explained and clearly stated.

Make sure that your style and tone are appropriate for your subject and audience. Tailor your language and word choice to these two factors, while still being true to your own voice.

Finally, write a conclusion that effectively summarizes the main argument and reinforces your thesis. 

Choose one of the topics you have been working on throughout this section. Use the thesis, evidence, opposing argument, and concessionary statement as the basis for writing a full persuasive essay. Be sure to include an engaging introduction, clear explanations of all the evidence you present, and a strong conclusion.

How to write a persuasive essay

Most composition classes you’ll take will teach the art of persuasive writing. That’s a good thing.

Knowing where you stand on issues and knowing how to argue for or against something is a skill that will serve you well both inside and outside of the classroom.

Persuasion is the art of using logic to prompt audiences to change their mind or take action , and is generally seen as accomplishing that goal by appealing to emotions and feelings.

A persuasive essay is one that attempts to get a reader to agree with your perspective.

What is a persuasive essay?

Ready for some tips on how to produce a well-written, well-rounded, well-structured persuasive essay? Just say yes. I don’t want to have to write another essay to convince you!

How Do I Write a Persuasive Essay?

What are some good topics for a persuasive essay, how do i identify an audience for my persuasive essay, how do you create an effective persuasive essay, how should i edit my persuasive essay.

Your persuasive essay needs to have the three components required of any essay: the introduction , body , and conclusion .

That is essay structure. However, there is flexibility in that structure.

There is no rule (unless the assignment has specific rules) for how many paragraphs any of those sections need.

Although the components should be proportional; the body paragraphs will comprise most of your persuasive essay.

What should every essay include?

How Do I Start a Persuasive Essay?

As with any essay introduction, this paragraph is where you grab your audience’s attention, provide context for the topic of discussion, and present your thesis statement.

TIP 1: Some writers find it easier to write their introductions last. As long as you have your working thesis, this is a perfectly acceptable approach. From that thesis, you can plan your body paragraphs and then go back and write your introduction.

TIP 2: Avoid “announcing” your thesis. Don’t include statements like this:

  • “In my essay I will show why extinct animals should (not) be regenerated.”
  • “The purpose of my essay is to argue that extinct animals should (not) be regenerated.”

Announcements take away from the originality, authority, and sophistication of your writing.

Instead, write a convincing thesis statement that answers the question "so what?" Why is the topic important, what do you think about it, and why do you think that? Be specific.

How Many Paragraphs Should a Persuasive Essay Have?

This body of your persuasive essay is the section in which you develop the arguments that support your thesis. Consider these questions as you plan this section of your essay:

  • What arguments support your thesis?
  • What is the best order for your arguments?
  • What evidence do you have?
  • Will you address the opposing argument to your own?
  • How can you conclude convincingly?

TIP: Brainstorm and do your research before you decide which arguments you’ll focus on in your discussion. Make a list of possibilities and go with the ones that are strongest, that you can discuss with the most confidence, and that help you balance your rhetorical triangle .

What Should I Put in the Conclusion of a Persuasive Essay?

The conclusion is your “mic-drop” moment. Think about how you can leave your audience with a strong final comment.

And while a conclusion often re-emphasizes the main points of a discussion, it shouldn’t simply repeat them.

TIP 1: Be careful not to introduce a new argument in the conclusion—there’s no time to develop it now that you’ve reached the end of your discussion!

TIP 2 : As with your thesis, avoid announcing your conclusion. Don’t start your conclusion with “in conclusion” or “to conclude” or “to end my essay” type statements. Your audience should be able to see that you are bringing the discussion to a close without those overused, less sophisticated signals.

The conclusion of a persuasive essay

If your instructor has assigned you a topic, then you’ve already got your issue; you’ll just have to determine where you stand on the issue. Where you stand on your topic is your position on that topic.

Your position will ultimately become the thesis of your persuasive essay: the statement the rest of the essay argues for and supports, intending to convince your audience to consider your point of view.

If you have to choose your own topic, use these guidelines to help you make your selection:

  • Choose an issue you truly care about
  • Choose an issue that is actually debatable

Simple “tastes” (likes and dislikes) can’t really be argued. No matter how many ways someone tries to convince me that milk chocolate rules, I just won’t agree.

It’s dark chocolate or nothing as far as my tastes are concerned.

Similarly, you can’t convince a person to “like” one film more than another in an essay.

You could argue that one movie has superior qualities than another: cinematography, acting, directing, etc. but you can’t convince a person that the film really appeals to them.

Debatable and non-debatable concepts

Once you’ve selected your issue, determine your position just as you would for an assigned topic. That position will ultimately become your thesis.

Until you’ve finalized your work, consider your thesis a “working thesis.”

This means that your statement represents your position, but you might change its phrasing or structure for that final version.

When you’re writing an essay for a class, it can seem strange to identify an audience—isn’t the audience the instructor?

Your instructor will read and evaluate your essay, and may be part of your greater audience, but you shouldn’t just write for your teacher.

Think about who your intended audience is.

For an argument essay, think of your audience as the people who disagree with you—the people who need convincing.

That population could be quite broad, for example, if you’re arguing a political issue, or narrow, if you’re trying to convince your parents to extend your curfew.

Once you’ve got a sense of your audience, it’s time to consult with Aristotle. Aristotle’s teaching on persuasion has shaped communication since about 330 BC. Apparently, it works.

Ethos, pathos and logos

Aristotle taught that in order to convince an audience of something, the communicator needs to balance the three elements of the rhetorical triangle to achieve the best results.

Those three elements are ethos , logos , and pathos .

Ethos relates to credibility and trustworthiness. How can you, as the writer, demonstrate your credibility as a source of information to your audience?

How will you show them you are worthy of their trust?

How to make your essay credible

  • You show you’ve done your research: you understand the issue, both sides
  • You show respect for the opposing side: if you disrespect your audience, they won’t respect you or your ideas

Logos relates to logic. How will you convince your audience that your arguments and ideas are reasonable?

How to use logic in essays

You provide facts or other supporting evidence to support your claims.

That evidence may take the form of studies or expert input or reasonable examples or a combination of all of those things, depending on the specific requirements of your assignment.

Remember: if you use someone else’s ideas or words in your essay, you need to give them credit.

Pathos relates to emotion. Audiences are people and people are emotional beings. We respond to emotional prompts. How will you engage your audience with your arguments on an emotional level?

How to use emotion in essays

  • You make strategic word choices : words have denotations (dictionary meanings) and also connotations, or emotional values. Use words whose connotations will help prompt the feelings you want your audience to experience.
  • You use emotionally engaging examples to support your claims or make a point, prompting your audience to be moved by your discussion.

Be mindful as you lean into elements of the triangle. Too much pathos and your audience might end up feeling manipulated, roll their eyes and move on.

An “all logos” approach will leave your essay dry and without a sense of voice; it will probably bore your audience rather than make them care.

Once you’ve got your essay planned, start writing! Don’t worry about perfection, just get your ideas out of your head and off your list and into a rough essay format.

You can develop your powers of persuasion every day just by observing what’s around you.

  • How is that advertisement working to convince you to buy a product?
  • How is a political candidate arguing for you to vote for them?
  • How do you “argue” with friends about what to do over the weekend, or convince your boss to give you a raise?
  • How are your parents working to convince you to follow a certain academic or career path?

As you observe these arguments in action, evaluate them. Why are they effective or why do they fail?

How could an argument be strengthened with more (or less) emphasis on ethos, logos, and pathos?

Every argument is an opportunity to learn! Observe them, evaluate them, and use them to perfect your own powers of persuasion.

When do you write an argumentative essay, approaches to argumentative essays, introducing your argument, the body: developing your argument, concluding your argument, other interesting articles, frequently asked questions about argumentative essays.

You might be assigned an argumentative essay as a writing exercise in high school or in a composition class. The prompt will often ask you to argue for one of two positions, and may include terms like “argue” or “argument.” It will frequently take the form of a question.

The prompt may also be more open-ended in terms of the possible arguments you could make.

Argumentative writing at college level

At university, the vast majority of essays or papers you write will involve some form of argumentation. For example, both rhetorical analysis and literary analysis essays involve making arguments about texts.

In this context, you won’t necessarily be told to write an argumentative essay—but making an evidence-based argument is an essential goal of most academic writing, and this should be your default approach unless you’re told otherwise.

Examples of argumentative essay prompts

At a university level, all the prompts below imply an argumentative essay as the appropriate response.

Your research should lead you to develop a specific position on the topic. The essay then argues for that position and aims to convince the reader by presenting your evidence, evaluation and analysis.

  • Don’t just list all the effects you can think of.
  • Do develop a focused argument about the overall effect and why it matters, backed up by evidence from sources.
  • Don’t just provide a selection of data on the measures’ effectiveness.
  • Do build up your own argument about which kinds of measures have been most or least effective, and why.
  • Don’t just analyze a random selection of doppelgänger characters.
  • Do form an argument about specific texts, comparing and contrasting how they express their thematic concerns through doppelgänger characters.

An argumentative essay should be objective in its approach; your arguments should rely on logic and evidence, not on exaggeration or appeals to emotion.

There are many possible approaches to argumentative essays, but there are two common models that can help you start outlining your arguments: The Toulmin model and the Rogerian model.

Toulmin arguments

The Toulmin model consists of four steps, which may be repeated as many times as necessary for the argument:

  • Make a claim
  • Provide the grounds (evidence) for the claim
  • Explain the warrant (how the grounds support the claim)
  • Discuss possible rebuttals to the claim, identifying the limits of the argument and showing that you have considered alternative perspectives

The Toulmin model is a common approach in academic essays. You don’t have to use these specific terms (grounds, warrants, rebuttals), but establishing a clear connection between your claims and the evidence supporting them is crucial in an argumentative essay.

Say you’re making an argument about the effectiveness of workplace anti-discrimination measures. You might:

  • Claim that unconscious bias training does not have the desired results, and resources would be better spent on other approaches
  • Cite data to support your claim
  • Explain how the data indicates that the method is ineffective
  • Anticipate objections to your claim based on other data, indicating whether these objections are valid, and if not, why not.

Rogerian arguments

The Rogerian model also consists of four steps you might repeat throughout your essay:

  • Discuss what the opposing position gets right and why people might hold this position
  • Highlight the problems with this position
  • Present your own position , showing how it addresses these problems
  • Suggest a possible compromise —what elements of your position would proponents of the opposing position benefit from adopting?

This model builds up a clear picture of both sides of an argument and seeks a compromise. It is particularly useful when people tend to disagree strongly on the issue discussed, allowing you to approach opposing arguments in good faith.

Say you want to argue that the internet has had a positive impact on education. You might:

  • Acknowledge that students rely too much on websites like Wikipedia
  • Argue that teachers view Wikipedia as more unreliable than it really is
  • Suggest that Wikipedia’s system of citations can actually teach students about referencing
  • Suggest critical engagement with Wikipedia as a possible assignment for teachers who are skeptical of its usefulness.

You don’t necessarily have to pick one of these models—you may even use elements of both in different parts of your essay—but it’s worth considering them if you struggle to structure your arguments.

Regardless of which approach you take, your essay should always be structured using an introduction , a body , and a conclusion .

Like other academic essays, an argumentative essay begins with an introduction . The introduction serves to capture the reader’s interest, provide background information, present your thesis statement , and (in longer essays) to summarize the structure of the body.

The spread of the internet has had a world-changing effect, not least on the world of education. The use of the internet in academic contexts is on the rise, and its role in learning is hotly debated. For many teachers who did not grow up with this technology, its effects seem alarming and potentially harmful. This concern, while understandable, is misguided. The negatives of internet use are outweighed by its critical benefits for students and educators—as a uniquely comprehensive and accessible information source; a means of exposure to and engagement with different perspectives; and a highly flexible learning environment.

The body of an argumentative essay is where you develop your arguments in detail. Here you’ll present evidence, analysis, and reasoning to convince the reader that your thesis statement is true.

In the standard five-paragraph format for short essays, the body takes up three of your five paragraphs. In longer essays, it will be more paragraphs, and might be divided into sections with headings.

Each paragraph covers its own topic, introduced with a topic sentence . Each of these topics must contribute to your overall argument; don’t include irrelevant information.

This example paragraph takes a Rogerian approach: It first acknowledges the merits of the opposing position and then highlights problems with that position.

A common frustration for teachers is students’ use of Wikipedia as a source in their writing. Its prevalence among students is not exaggerated; a survey found that the vast majority of the students surveyed used Wikipedia (Head & Eisenberg, 2010). An article in The Guardian stresses a common objection to its use: “a reliance on Wikipedia can discourage students from engaging with genuine academic writing” (Coomer, 2013). Teachers are clearly not mistaken in viewing Wikipedia usage as ubiquitous among their students; but the claim that it discourages engagement with academic sources requires further investigation. This point is treated as self-evident by many teachers, but Wikipedia itself explicitly encourages students to look into other sources. Its articles often provide references to academic publications and include warning notes where citations are missing; the site’s own guidelines for research make clear that it should be used as a starting point, emphasizing that users should always “read the references and check whether they really do support what the article says” (“Wikipedia:Researching with Wikipedia,” 2020). Indeed, for many students, Wikipedia is their first encounter with the concepts of citation and referencing. The use of Wikipedia therefore has a positive side that merits deeper consideration than it often receives.

An argumentative essay tends to be a longer essay involving independent research, and aims to make an original argument about a topic. Its thesis statement makes a contentious claim that must be supported in an objective, evidence-based way.

An expository essay also aims to be objective, but it doesn’t have to make an original argument. Rather, it aims to explain something (e.g., a process or idea) in a clear, concise way. Expository essays are often shorter assignments and rely less on research.

At college level, you must properly cite your sources in all essays , research papers , and other academic texts (except exams and in-class exercises).

Add a citation whenever you quote , paraphrase , or summarize information or ideas from a source. You should also give full source details in a bibliography or reference list at the end of your text.

The exact format of your citations depends on which citation style you are instructed to use. The most common styles are APA , MLA , and Chicago .

The majority of the essays written at university are some sort of argumentative essay . Unless otherwise specified, you can assume that the goal of any essay you’re asked to write is argumentative: To convince the reader of your position using evidence and reasoning.

In composition classes you might be given assignments that specifically test your ability to write an argumentative essay. Look out for prompts including instructions like “argue,” “assess,” or “discuss” to see if this is the goal.

Opinion, Persuasive, and Argument Writing: What's the Difference?

Most of the teachers I've been working with this past fall are knee-deep into the (relatively!) new Units of Study for Writing Workshop put out by Lucy Calkins and her brilliant team. One of the most common questions I've been asked these last few months is about the differences between opinion, persuasive and argument writing.

I've heard kindergarten teachers fret over thinking they must get their five-year-olds to engage in critical debates over whether Frozen or Tangled is the most magical movie of all time... and then write about it! And teachers of fifth-graders are wondering why their students are writing superficial essays about which subject is their favorite.

The differences between the genres can seem slight and this confusion can cause teachers to plan lessons that may not be developmentally appropriate. What is an argumentative essay?

The argumentative essay is a genre of writing that requires the student to investigate a topic; collect, generate, and evaluate evidence; and establish a position on the topic in a concise manner.

Please note : Some confusion may occur between the argumentative essay and the expository essay. These two genres are similar, but the argumentative essay differs from the expository essay in the amount of pre-writing (invention) and research involved. The argumentative essay is commonly assigned as a capstone or final project in first year writing or advanced composition courses and involves lengthy, detailed research. Expository essays involve less research and are shorter in length. Expository essays are often used for in-class writing exercises or tests, such as the GED or GRE.

Argumentative essay assignments generally call for extensive research of literature or previously published material. Argumentative assignments may also require empirical research where the student collects data through interviews, surveys, observations, or experiments. Detailed research allows the student to learn about the topic and to understand different points of view regarding the topic so that she/he may choose a position and support it with the evidence collected during research. Regardless of the amount or type of research involved, argumentative essays must establish a clear thesis and follow sound reasoning.

The structure of the argumentative essay is held together by the following.

  • A clear, concise, and defined thesis statement that occurs in the first paragraph of the essay.

In the first paragraph of an argument essay, students should set the context by reviewing the topic in a general way. Next the author should explain why the topic is important ( exigence ) or why readers should care about the issue. Lastly, students should present the thesis statement. It is essential that this thesis statement be appropriately narrowed to follow the guidelines set forth in the assignment. If the student does not master this portion of the essay, it will be quite difficult to compose an effective or persuasive essay.

  • Clear and logical transitions between the introduction, body, and conclusion.

Transitions are the mortar that holds the foundation of the essay together. Without logical progression of thought, the reader is unable to follow the essay’s argument, and the structure will collapse. Transitions should wrap up the idea from the previous section and introduce the idea that is to follow in the next section.

  • Body paragraphs that include evidential support.

Each paragraph should be limited to the discussion of one general idea. This will allow for clarity and direction throughout the essay. In addition, such conciseness creates an ease of readability for one’s audience. It is important to note that each paragraph in the body of the essay must have some logical connection to the thesis statement in the opening paragraph. Some paragraphs will directly support the thesis statement with evidence collected during research. It is also important to explain how and why the evidence supports the thesis ( warrant ).

However, argumentative essays should also consider and explain differing points of view regarding the topic. Depending on the length of the assignment, students should dedicate one or two paragraphs of an argumentative essay to discussing conflicting opinions on the topic. Rather than explaining how these differing opinions are wrong outright, students should note how opinions that do not align with their thesis might not be well informed or how they might be out of date.

  • Evidential support (whether factual, logical, statistical, or anecdotal).

The argumentative essay requires well-researched, accurate, detailed, and current information to support the thesis statement and consider other points of view. Some factual, logical, statistical, or anecdotal evidence should support the thesis. However, students must consider multiple points of view when collecting evidence. As noted in the paragraph above, a successful and well-rounded argumentative essay will also discuss opinions not aligning with the thesis. It is unethical to exclude evidence that may not support the thesis. It is not the student’s job to point out how other positions are wrong outright, but rather to explain how other positions may not be well informed or up to date on the topic.

  • A conclusion that does not simply restate the thesis, but readdresses it in light of the evidence provided.

It is at this point of the essay that students may begin to struggle. This is the portion of the essay that will leave the most immediate impression on the mind of the reader. Therefore, it must be effective and logical. Do not introduce any new information into the conclusion; rather, synthesize the information presented in the body of the essay. Restate why the topic is important, review the main points, and review your thesis. You may also want to include a short discussion of more research that should be completed in light of your work.

A complete argument

Perhaps it is helpful to think of an essay in terms of a conversation or debate with a classmate. If I were to discuss the cause of World War II and its current effect on those who lived through the tumultuous time, there would be a beginning, middle, and end to the conversation. In fact, if I were to end the argument in the middle of my second point, questions would arise concerning the current effects on those who lived through the conflict. Therefore, the argumentative essay must be complete, and logically so, leaving no doubt as to its intent or argument.

The five-paragraph essay

A common method for writing an argumentative essay is the five-paragraph approach. This is, however, by no means the only formula for writing such essays. If it sounds straightforward, that is because it is; in fact, the method consists of (a) an introductory paragraph (b) three evidentiary body paragraphs that may include discussion of opposing views and (c) a conclusion.

Longer argumentative essays

Complex issues and detailed research call for complex and detailed essays. Argumentative essays discussing a number of research sources or empirical research will most certainly be longer than five paragraphs. Authors may have to discuss the context surrounding the topic, sources of information and their credibility, as well as a number of different opinions on the issue before concluding the essay. A writer of a persuasive essay needs to do research, gather evidence, but a clever writer can create a successful essay without knowing much. This is because; a persuasive writing appeals more to reader’s emotions rather than minds. In persuasive writing, the writer should have certain awareness about the audience . For example, opinions and ideas that could appeal to teenagers may not have the same effect on adults. First person narration and Second person narration (Ex: In my opinion, I believe, etc.,) are commonly used as the writer is addressing the audience directly.

When it comes preparations, before writing an argumentative essay, the writer needs to do a thorough research on the subject but does not need to have the knowledge about the audience. On the other hand, the writer can write a persuasive essay even without doing much research, but he should have certain  knowledge about the audience.

Difference Between Argumentative and Persuasive Essay

When we look at both types of essays in the perspective of the audience; an argumentative essay appeals to the minds of the readers whereas, a persuasive essay appeals to the hearts of the readers. Also,  an argumentative essay acknowledges opposing views, but a persuasive essay may not acknowledge opposing views.

What’s the difference between an argumentative essay and an opinion essay? In both, you share your perspective on an issue that you think is important, but they are written in different formats and have different purposes in the academic world. For example, when writing an argumentative essay, you usually present the opposing viewpoint to your own opinion and then refute it with solid evidence. On the other hand, opinion essays are based solely on your personal viewpoint and there isn’t much of a structure to how you choose to write it, as long as it’s well-organized and easy to read.

What is an argumentative essay?

An argument essay is one of two basic types of essays that you’ll encounter in your college writing classes: an argumentative essay and an expository essay. In contrast to an expository essay, which explains something, an argument essay does not explain anything; instead, it tries to convince its audience of a certain point of view on a given topic. An argumentative essay is intended to convince readers that your opinion or position on a topic is correct. It may focus on a current issue, such as gun control, or it may be more general in nature. In any case, your thesis will identify what you want to convince readers of: for example, you might argue that social media has had a positive impact on society or that it is harmful. You’ll then use evidence from research and personal experience to support your point of view. You can also write an argumentative essay about a fictional situation, in which case you’ll need to make up facts rather than rely on real-world data.

What’s an opinion essay?

Although both of these types of essays are meant to argue a point, they do so in different ways. With an opinion essay, you’re arguing your point through personal reflection or experience; in an argumentative essay, you’re taking a side on an issue and proving that position with facts, data and other evidence.

This is an essay that presents a point of view on a given subject, usually something controversial. They’re sometimes referred to as op-eds, short for opposite editorial pages. Opinion essays are similar to arguments but written in essay format rather than paragraph format. Unlike arguments, opinion pieces can support their claims with examples from personal experience or evidence found in sources, just like any other essay.

The main difference between an opinion essay and an argumentative essay is that an opinion essay doesn’t have any research behind it—it simply states your own personal viewpoint about something.   • Out of this world . Do aliens exist? Why or why not?
  • Social media. Is social media good or bad for society? Why?

An argumentative essay is completely different in terms of its starting point. You have to choose a topic, research it in-depth, and then decide which side you’d like to support using reasonable and sufficient evidence.

Argumentative essay writing requires an authoritative tone in order to make your ideas clear.

To demonstrate your authoritativeness on the topic, and to prove to the reader that you can argue your points, you need to use a formal tone as well as the right language to complete the essay. 

More often than not, your arguments have to reflect a consistent use of a somewhat complex language, as it’s necessary to fill the assignment with the technical terms related to the subject.

It’s a completely different case in persuasive writing.

Here’s where you write as if you’re talking a friend, and therefore you can use a more relaxed tone that identifies with your readers’ emotions, sense of humor, intelligence, and sometimes ego.

Difference in Purpose

The purpose of persuasive writing is to express your thoughts and beliefs in hope to convince your audience to share your point of view.

You may have a claim in persuasive writing, but there are often no solid and undeniable facts to present so as to defend your position.

For what it’s worth, especially since the primary goal is to sway the reader in hope that they either agree with you or take an action, often a persuasive essay tends to use a non-formal kind of debate and emotional appeal.

The purpose of an argument is completely different. Authors need to invest in research and come up with compelling arguments to defend their positions. 

Instead of swaying your audience, you present the evidence for or against an argument and let your audience decides whether to take your stand or to write off your argument completely.

Difference in Conclusion

In argumentative essay writing, your conclusion should demonstrate two things.

First, demonstrate the position you take in the argument, and second, let the reader know that they can recognize other point of view.

By doing so, you not only demonstrate that you put effort in researching your topic but also establish that your stand is the best among all in relation to the topic in question.

The conclusion of a persuasive essay isn’t as robust and may not even be as convincing.

First, the end of the essay tries to put a reader in the position to accept that an author’s thoughts are the only source of information on the subject in question.

In a way, the assumption is that the author expects the reader will recognize and agree with their stand.

Academic writing is characterized by its emphasis on facts and observations, its presence within a specified body of knowledge, and its reference to sources (prior learning) by which the reader can evaluate the trustworthiness of the academic book or article.

Within the field of writing, there are four main genres: descriptive, persuasive, expository, and narrative. When generating a piece of academic writing, the author may utilize skills from any of the four genres,​ and within each of these categories, specific types of academic assignments may be presented. This page provides an overview of each genre of writing as well as presents the types of academic papers that utilize that genre of writing.

Also commonly referred to as argumentative writing, persuasive writing occurs when the author takes a stand on a principle or controversial issue and attempts to persuade the reader to adopt a similar mindset. When using persuasive writing, the author will appeal to reason, emotion, or character (ethics) to build their argument. 

​Within the academic context, the most common persuasive technique for authors to use is to appeal to reason and logic. Persuasive writing that appeals to logic involves incorporating critical thinking and often the use of outside sources for evidence.

Research-Based Papers

A research-based paper requires that the writer conducts research using methods such as library searches prior to authoring the work. Within the paper, the author must identify and cite the literature to support their original idea, position, or argument. Research-based papers usually center around an argument or idea, known as the thesis, that is developed throughout the body of the paper. The thesis of the paper is supported by the evidence drawn from the research. In order to present an effective position or argument, the author must utilize clear writing, organization, and logic. Do not confuse this type of paper with a literature review, described in a later section.

Critical Review ​

Usually focused on writing authored by someone else, this describes and assesses a theoretical concept, article, or research report critically and analytically. In a critical review, the author either agrees or disagrees with the original work that is being critiqued. In either circumstance, the author is persuading the reader toward a particular opinion about the work that is being examined. Examples include evaluations of research articles, book reviews, and critiques of published literature reviews and dissertations.

Expository Writing

Expository papers present information objectively and are used to inform, compare and contrast, or show cause and effect. Information presented in expository writing should be clear and concise.

This is the most common type of writing at the graduate level within many of the fields offered at Saybrook. Since the purpose of expository writing is to inform the reader, it is used heavily within academic contexts.

Literature Review

This is a comprehensive report on the existing literature available regarding a topic or question. A literature review describes, summarizes, evaluates, and synthesizes scholarly articles, books, research reports, dissertations, conference proceedings,​ and other sources of information relevant to a specific question or topic. The writer critically analyzes the method, results, discussion, and/or conclusions from multiple research articles. A good literature review goes beyond simply reporting and summarizing related literature: it evaluates, organizes, and synthesizes what others have researched and written on the topic. Evaluating begins with identifying and reporting crucial elements in individual studies. It is equally important to organize the individual studies into categories or themes found in the literature, noting how strong or lacking the evidence appears. The final quality of synthesis allows the literature review author to repackage what is known and add their insights to the collective knowledge. Thus, a good literature review will not only report on studies and collective knowledge, but also compare different perspectives, identify inconsistencies and offer possible explanations, and comment on how knowledge has evolved over time.

​Pr​é​cis 

A précis is a recapitulation of the original work at 25%–33% of the original size. It contains no interpretation or critique elements and should not include the voice of the précis writer. It should be a substitute for the original work, like an executive summary. The purpose is to report the core essence of the work that is clear and concise. When used to summarize a research article, the précis should include the topic or main thesis, the purpose of the research, what was studied, what methods were applied, the findings or results, and a conclusion or discussion.

Original Empirical​​​ Research Report

Original empirical research reports provide an original qualitative, quantitative, or mixed-method research project in which the student-designed the study, conducted the fieldwork and data collection, analyzed the data, and created the report. Examples within graduate coursework include the pilot study report, a thesis, and a dissertation. Published original research articles are also empirical research reports. Examples are:

Persuasive vs. Expository Writing

Persuasive and expository writing may share similar traits. For example, research plays a critical role in both genres​. However, the purpose is different. Table 1 provides a description of traits of each genre of writing.

Descriptive Writng

Descrip​tive writing uses vivid language to describe a person, place, or event so that the reader can picture the topic clearly in their mind. 

​Some qualitative research methods call for data collection through such rich descriptions (e.g., phenomenological protocols, narrative re-storying). Although it is unlikely for a student at Saybrook to receive an essay prompt requiring a descriptive approach, the skill is useful for describing personal observations. Note that within academic writing, descriptive writing should remain neutral and use clear and concise wording.

Narrative Writing

Narrative writing tells the reader about a particular event(s) that took place. Common works of narrative writing include personal essays (such as those found in a blog post), practicum logs, and case reports.

This form of essay writing is less common in graduate-level writing within the fields offered at Saybrook University. However, a student may still encounter essay prompts that suggest a narrative approach. For example, a professor may ask you to analyze a theory or concept in light of a personal experience.

Reflection Paper

A reflection paper relies on the writer's anecdotal experiences and personal reflections to convey an idea, an experience, or a concept. Although not dependent on externally derived evidence, such as scholarly literature, reflection papers still require clarity, logical organization, and basic rhetorical skills for effective execution.

Descriptive vs. Narrative Writing

Descriptive and narrative writing may be easily confused because both allow the writer to express themselves using more creative and personal methods. While both use similar writing skills, there are some distinct differences. Table 2 provides a description of traits of each genre of writing.

What is the difference between persuasive essay and argumentative?

There are some of you out there that wish they had a Dr. Seuss or Shakespeare gene because you feel writing isn’t your forte. Don’t worry we all do. Writing just a few lines can seem like a daunting task. Especially when your teacher/lecturer specifies that your 2,000-word essay has to be argumentative or persuasive. That’s when you wish the world could just open up and swallow you whole, so you totally have a good excuse for a missed essay.

What’s the Primary Difference Between Argumentative and Persuasive?

Let’s get to the nuts and bolts to this dilemma. When you are faced with persuasive writing you’re dealing with emotion. You are trying to influence or change another person’s mind with your words. The writer tries to make the reader feel better about them by agreeing to the cause. For instance, an advert of a sweet puppy with the title, “How much do you love me?”, or an advert asking “Hands up who wants our kids to live longer?”

An argumentative writing approach is more formal and academic. The writer has to back up his or her argument with hard evidence. This is what persuasive writing is lacking since it’s all about making the reader feel the heartfelt emotion or the writer’s well-defended opinion. Argumentative writing has to dig a little deeper and refer to scientific studies and quotes from experts.

For example, an advert that says, “Smoking Kills”, obviously this claim is backed up by the FDA and WHO. Or by stating that Colgate toothpaste reduces plaque up to 98% for 12 hours, the brand is using scientific evidence to prove its usefulness.

Amy Coney Barrett Sounds Fed Up with Clarence Thomas’ Sloppy Originalism

This is part of  Opinionpalooza , Slate’s coverage of the major decisions from the Supreme Court this June. A minor dispute over a trademark registration erupted into a heated battle over originalism at the Supreme Court last week, splintering the justices into warring camps over the value and practicality of history in constitutional analysis. No surprise there—as the term accelerates toward a contentious finale, the tensions roiling major cases are bound to spill over into littler ones. What’s remarkable is who seized on this squabble over intellectual property to launch a scathing salvo against the conservative majority’s “laser-like focus” on “supposed history and tradition”: Justice Amy Coney Barrett, a conservative who presented as a true believer in originalism when joining the Supreme Court four years ago. Barrett’s latest opinion exudes disenchantment with the methodology, at least as it’s used by this court; it also suggests she has buyer’s remorse about signing on to Bruen , a significant expansion of the Second Amendment that’s arguably the most radical and unworkable “originalist” opinion she’s joined so far.

We will know soon enough. Last week’s squabble reads like shadowboxing over a much bigger decision to come: U.S. v. Rahimi , a follow-up to the Bruen decision. Rahimi gives the court an opportunity to walk back the most disastrous and lethal aspects of its Second Amendment extremism. Barrett now seems like she may be eager to take it.

Vidal v. Elster , last Thursday’s decision, is not the kind of case that usually makes headlines. Steve Elster is a labor lawyer who wanted to trademark the phrase “Trump too small,” inspired by Sen. Marco Rubio’s crude debate joke about Donald Trump’s hands in 2016. The Patent and Trademark Office, however, refused to register the trademark, citing a law that bars trademarks made up of a name “identifying a particular living individual except by his written consent.” (Needless to say, the former president did not give his consent.) Elster sued, alleging a violation of the First Amendment. He pointed out that the Supreme Court has held that two similar provisions of federal law violate free speech, one that bars disparaging trademarks and another that bars “ immoral or scandalous ” trademarks. So, he argued, the prohibition against trademarks that use other people’s names—the so-called names clause—should also be declared unconstitutional.

The Supreme Court unanimously ruled against Elster, upholding the statute. But the justices fractured badly on the reason why, dividing more or less into a 5–4 split. Writing for the five men, Justice Clarence Thomas relied exclusively upon history (or his version of it) to resolve the case. Typically, he explained, laws that discriminate on the basis of content—that is, their “topic,” “idea,” or “message”—are subject to heightened scrutiny under the First Amendment. And by targeting trademarks that reference other people, the “names clause” is a “content-based regulation of speech.” But Thomas then declared that the law is not constitutionally suspect because it aligns with the “history and tradition” of the nation “since the founding.” Trademark restrictions “have always turned on a mark’s content” yet “have always coexisted with the First Amendment,” so they represent an exception to the usual constitutional limitations. Embarking upon a grand journey from the 1700s through today, Thomas presented a smattering of comparable laws from the past to demonstrate this “historical rule.” In short, he concluded, it has always been done, so it always may be done. Case closed.

In a separate opinion, Barrett agreed with Thomas’ bottom line but sharply disagreed with pretty much everything else. His history-only approach, she wrote, was “wrong twice over”: Thomas both botched the relevant history and failed to make a persuasive case for its use in the first place. Start with “the court’s evidence.” Thomas’ law-office history , Barrett explained, consists of “loosely related cases from the late-19th and early-20th centuries” that do not “establish a historical analogue for the names clause.” His analysis of these cases is shallow and often dubious; Barrett highlighted unfounded inferences in Thomas’ skim of the historical record, questioning his generalizations from a handful of archaic decisions. She also noted that Thomas declined to “fully grapple with countervailing evidence,” citing old decisions that cut against his conclusory assertions.

Clearly, Barrett is growing tired of her colleague’s bogus originalism: She also criticized his highly selective frolic through the archives in last term’s Samia v. U.S. , questioning his reliance on a somewhat random “snapshot” of history to cut back protections of the Sixth Amendment. “The court overclaims,” the justice wrote then, risking “undermining the force of historical arguments when they matter most.”

But this time, Barrett’s critique cuts much deeper: Thomas, she wrote, “never explains why hunting for historical forebears on a restriction-by-restriction basis is the right way to analyze the constitutional question.” The majority “presents tradition itself as the constitutional argument,” as though it is “dispositive of the First Amendment issue,” without any “theoretical justification.” In a passage that must have made the liberal justices proud, Barrett continued: “Relying exclusively on history and tradition may seem like a way of avoiding judge-made tests. But a rule rendering tradition dispositive is itself a judge-made test. And I do not see a good reason to resolve this case using that approach rather than by adopting a generally applicable principle.” Plucking out historical anecdotes, ad libbing some connective tissue, then presenting the result as a constitutional principle “misses the forest for the trees.” When applying “broadly worded” constitutional text, “courts must inevitably articulate principles to resolve individual cases.” This approach brings sorely needed “clarity to the law.”

Barrett sketched out a better path: assessing the “names clause” within a framework “grounded in both trademark law and First Amendment precedent.” When the government “opens its property to speech,” she wrote, restrictions are permissible so long as they aren’t cover for the “official suppression of ideas.” Thus, courts should uphold trademark laws if they “are reasonable in light of the trademark system’s purpose.”

Why did Barrett spill so much ink repudiating Thomas’ opinion when the two justices landed in the same place? Her opinion reads like a rebuttal of Bruen , Thomas’ 2022 decision establishing a novel right to carry guns in public—which Barrett joined in full. Bruen marked a sea change because it upended the way courts looked at firearm restrictions. Previously, the courts of appeals applied heightened scrutiny to gun laws, asking whether the regulation was carefully drawn to further public safety. SCOTUS applies this test in countless other contexts, including the First Amendment and equal protection. It requires judges to balance the interests on both sides, a well-worn tool of judicial review. Yet Thomas spurned this “means-ends scrutiny,” demanding that courts rely exclusively on the nation’s “history and tradition”: A gun restriction, he wrote, is only constitutional if it has a sufficient number of “historical analogues” from the distant past.

This brand-new test has flummoxed the lower courts and led to ludicrous outcomes —partly because judges are not historians and have no reliable way to produce a complete historical record, and also because American society has evolved to the point that a great deal of “tradition” now looks barbaric . This term, the Supreme Court has been confronted with the fallout from Bruen in a follow-up called Rahimi , which asks whether domestic abusers have a right to bear arms . During oral arguments in Rahimi , Barrett sounded deeply uncomfortable with what her court had wrought. Rahimi has not yet been decided. But Barrett’s concurrence in Elster reads like a preview of her opinion in that case. The justice seems to have second thoughts about pinning constitutional interpretation entirely on a court’s amateur historical analysis; she now seems to see the immense value in “adopting a generally applicable principle” that courts can apply across cases.

The liberal justices were right there alongside Barrett in Elster , gladly signing on to her more sensible approach to the case. Justice Sonia Sotomayor also wrote a separate concurrence raising many of Barrett’s objections, taking more explicit aim at Bruen and the “confusion” it has caused. And some of Barrett’s Elster concurrence echoes a recent opinion by Justice Elena Kagan—which Barrett notably joined—that offered an alternative to Thomas’ rigid focus on founding-era history in a case upholding the constitutionality of the Consumer Financial Protection Bureau.

This shadowboxing foreshadows a bitter split in Rahimi , though with Barrett and the liberals appear poised to wind up on the winning side. There’s no doubt that Barrett is still a Second Amendment enthusiast , but with one more vote, this bloc is well positioned to walk back the excesses of Bruen . What’s certain right now is that the justice, at a minimum, has serious doubts about the legitimacy and workability of this Supreme Court’s sloppy, results-oriented originalism . That doesn’t mean Barrett has abandoned her broader commitment to the conservative legal movement’s cause. But it does signal a disillusionment with conservative orthodoxies that could put her vote up for grabs in cases much more important than a trademark dispute.

Remembering Willie Mays as Both Untouchable and Human

Mays, who died on Tuesday at 93, had been perfect for so long that the shock of seeing baseball get the best of him was the shock of seeing a god become mortal.

At the end, the Say Hey Kid looked nothing like the extraordinary force who had been at the center of the American imagination for much of the 20th century.

The Kid — Willie Mays — struggled at the plate and stumbled on the basepaths. A line drive arced his way, easily catchable for Mays during most of his career. But he fell. Another outfield mistake caused the game to be tied in the ninth inning.

He was a creaky-kneed 42 years old on that October afternoon, Game 2 of the 1973 World Series — Mays’s New York Mets in Oakland facing the A’s. On the grandest stage, the ravages of time had settled upon the game’s most gilded star.

That he would redeem himself at the plate three innings later is often forgotten. The unthinkable had happened. Mays had not only failed, he had appeared lost, clumsy and out of sorts.

The shock of seeing him that way would linger long past his playing days as a warning: Don’t be like Willie Mays, sticking around too long, stumbling in center field, a shadow of his former self. Such became the axiom, uttered in so many words by everyone from politicians to business leaders to commentators weighing in on great athletes who yearn to play into their twilight.

Quit before it is too late.

In retirement, Mays, who died on Tuesday at 93, did his best to ignore the game that would be his last. But there is another way to view its echoes.
